FOIA and Public Access in Stafford County
Virginia's Freedom of Information Act at § 2.2-3704 gives the public the right to request government records from Stafford County agencies, including the Sheriff's Office and the courts. The law presumes all records are open unless a specific exemption applies. Agencies must respond within five working days.
Write your request to the records custodian at the agency that holds the records. You do not need to state a reason. Describe the records clearly: include the subject's name, approximate dates, and the type of document you want. Agencies can only charge for actual staff time and copy costs. For estimated costs over $200, the agency can require a deposit before starting the search.
Under Virginia law, the identity of arrested persons, the charges they face, and the status of those charges are public. Active investigations and juvenile records are exempt. The FOIA Advisory Council offers guidance and can be reached at (804) 698-1810 or foiacouncil@dls.virginia.gov.
Note: A 2021 change to FOIA expanded access to closed criminal investigative files. Agencies may take up to 60 additional work days to respond to those specific requests.Expungement of Stafford County Arrest Records
Under § 19.2-392.2, you may petition to have arrest records expunged and sealed if you were acquitted, if charges were dismissed or nolle prosequi, or if you were arrested but not charged and the record is inaccurate or unfairly harmful. An absolute pardon after a wrongful conviction may also qualify you.
Virginia does not generally permit expungement of convictions. If you were found guilty, that conviction typically stays on the public record. New laws effective July 2025 may allow some misdemeanor and felony convictions to be automatically sealed after waiting periods, but implementation is still ongoing.
To petition for expungement in Stafford County, file with the Circuit Court at the Stafford County Judicial Center. Describe the arrest and state the legal grounds for sealing. Fingerprints must be submitted to the Virginia State Police to verify identity. The Commonwealth's Attorney receives a copy of the petition and can oppose it. If opposed, the court schedules a hearing. Filing fees apply. The full expungement statute is at the Virginia General Assembly's Code search tool.
