Spotsylvania County Court Records

FOIA and Public Access in Spotsylvania County

Virginia's Freedom of Information Act at § 2.2-3704 gives every person the right to request public records from government agencies in Spotsylvania County. Expungement of Spotsylvania County Arrest Records

Under § 19.2-392.2 of the Code of Virginia, you may petition to have arrest records expunged and sealed from public view under certain conditions. Eligible situations include acquittal, dismissal or nolle prosequi, arrest without charges where the record is inaccurate or harmful, and absolute pardon after a wrongful conviction.

Virginia generally does not allow expungement of convictions. If you were found guilty, that conviction typically cannot be sealed. Starting in July 2025, new state laws may allow some convictions to be sealed automatically after waiting periods, though those provisions are still being implemented.

To file for expungement in Spotsylvania County, petition the Circuit Court on Courthouse Road. The petition must describe the arrest and the legal basis for sealing.
