Isle of Wight County Court Records

Isle of Wight County has both a Circuit Court and a General District Court. Each handles different types of criminal matters, and both keep public records you can search online or request in person.

The Circuit Court handles felony cases, trials, and sentencing. It also takes appeals from the General District Court. If you need records from a felony case in Isle of Wight County, start at the Circuit Court clerk's office. You can search case records using the Virginia Judiciary's online case search at no cost, or visit in person to get certified copies. Certified copies carry a fee per page set by state law.

The General District Court handles misdemeanor criminal cases, traffic violations, and preliminary hearings on felony charges. This court has a higher volume of daily cases. Both courts are located in the county seat. Under Virginia Code § 19.2-389, criminal history record information is maintained at the state level through the Central Criminal Records Exchange run by the Virginia State Police. Court records from both court levels in Isle of Wight County are accessible through the statewide case search system.

FOIA and Public Access in Isle of Wight County

Virginia's Freedom of Information Act at § 2.2-3704 of the Code of Virginia gives you the right to request government records including arrest records. The law assumes all public records are open unless a specific exemption applies. The Sheriff's Office and court clerks must respond to your FOIA request within five working days.

To request records under FOIA, send a written request to the records custodian at the Sheriff's Office or the court clerk. You do not need to explain why you want the records. Just describe them clearly enough for staff to find them. Include the name of the person, the approximate date, and what type of record you want. The agency can charge reasonable fees for staff time and copies but cannot add extra charges beyond actual cost. If the request is expected to cost more than $200, the agency may ask for a deposit before they proceed.

Under Virginia law, the identity of arrested persons, the charges against them, and the status of those charges must be disclosed. Active criminal investigations are exempt from disclosure. Juvenile records are confidential. If you have questions about the FOIA process, contact the FOIA Advisory Council at (804) 698-1810 or by email at foiacouncil@dls.virginia.gov.

Note: A 2021 change to Virginia FOIA expanded access to criminal investigative files once an investigation is complete. Agencies may take up to 60 additional work days to respond to those specific requests.

Expungement of Isle of Wight County Arrest Records

Virginia law allows certain arrest records to be expunged under § 19.2-392.2. You may petition for expungement if you were acquitted of charges, the charge was dismissed or nolle prosequi, or you were arrested but never formally charged and the record is misleading. Individuals who received an absolute pardon after a conviction may also qualify in some cases.

Expungement in Virginia generally does not cover convictions. If you were found guilty, you normally cannot have that conviction removed from your record. Starting in July 2025, however, new state laws allow certain misdemeanor and felony convictions to be sealed automatically after applicable waiting periods pass. This is a significant shift from how Virginia has handled convictions in the past.

To file for expungement in Isle of Wight County, you petition the Circuit Court. Your petition must include details about the arrest and the legal grounds for the request. You will also need to submit fingerprints through the Virginia State Police. The Commonwealth's Attorney will receive a copy and can oppose the petition. If there is a dispute, the court schedules a hearing. Filing fees apply at the Circuit Court clerk's office. Use the Virginia General Assembly Code search to read the full expungement statute.
