Cumberland County Sheriff's Office Arrest Records

The Cumberland County Sheriff's Office is the primary law enforcement agency for the county. It makes arrests, books individuals into the county jail, and keeps records of those bookings. When someone is arrested in Cumberland County, the Sheriff's Office creates a record that includes the name of the person, the charges, the date of arrest, and basic identifying information. These booking records are the starting point for most arrest record searches in the county.

You can contact the Sheriff's Office directly to ask about recent arrest activity or submit a records request. Staff can tell you what information is available and what the process looks like. Under Virginia law, the identity of a person arrested, the charges filed, and the status of those charges are public information. This means the Sheriff's Office must provide basic arrest details to anyone who asks, as long as the request does not involve a juvenile or an active investigation that has legal protection.

FOIA and Public Access in Cumberland County

Virginia's Freedom of Information Act gives the public a broad right to access government records. Under § 2.2-3704, all public records are presumed open unless a specific law exempts them. This includes arrest records held by the Cumberland County Sheriff's Office and the county courts.

When you submit a FOIA request to a Cumberland County agency, the office must respond within five working days. It can provide the records, deny the request with a legal citation, or notify you that more time is needed. If charges exceed $200, the agency can ask for a deposit before proceeding. Fees are limited to actual costs for searching, copying, and retrieving records. You do not have to explain why you want the records.

Arrest records covered under FOIA include the name of the person arrested, the charges, the date, and the current status. Active criminal investigations may be withheld under § 2.2-3706. Juvenile records are not public. Personnel records for sheriff's office staff are also typically exempt.

For questions about FOIA rights in Virginia, the FOIA Advisory Council offers guidance and can help if you believe a public body is not following the law. You can reach the council by phone at (804) 698-1810 or toll-free at 1-866-448-4100.

Note: If your FOIA request is denied, you have the right to appeal in Circuit Court or seek advisory guidance from the FOIA Council.

Expungement of Cumberland County Arrest Records

Virginia law allows some arrest records to be expunged under § 19.2-392.2. Expungement removes the arrest record from public access. Not every arrest qualifies. The law limits expungement mostly to cases where charges were dropped, the person was acquitted, or the case was otherwise resolved without a conviction.

To apply for expungement in Cumberland County, you file a petition with the Circuit Court in the county where the arrest took place. The petition must include your personal information, details about the arrest, and the legal basis for expungement. You also have to get fingerprinted through the Virginia State Police so they can verify your identity and check your full record. The Commonwealth's Attorney receives a copy and may oppose the petition if they believe expungement is not warranted.

Virginia does not allow expungement of most conviction records. If you were convicted of a crime in Cumberland County, the record generally stays. Absolute pardons are one of the few paths to expungement after a conviction, and those are rare. The law under § 19.2-389 governs how criminal history records are disseminated and maintained even after expungement petitions are filed.

If you think you may qualify for expungement, it helps to speak with an attorney first. The Circuit Court clerk can give you the petition forms but cannot provide legal advice. Virginia Legal Aid may be able to help if you qualify based on income.
