Local criminal history checks cover only arrests made within Middlesex County. For a statewide record covering all Virginia agencies, you need to use the Virginia State Police CARE system. Middlesex County Court Records

FOIA and Public Access in Middlesex County

Virginia's Freedom of Information Act at § 2.2-3704 gives citizens the right to request government records including arrest records. To request records under FOIA, write to the records custodian at the relevant agency. You don't need to explain why. Describe the records clearly enough so the agency can locate them. Expungement of Middlesex County Arrest Records

Under Virginia Code § 19.2-392.2, you can petition for expungement if you were acquitted, if the charge was dismissed or nolle prosequi, or if you were arrested but never formally charged and the record is misleading. An absolute pardon may also qualify in certain situations.

Expungement in Virginia does not generally apply to convictions. If you were found guilty, that record stays. Starting in July 2025, new state laws will allow certain misdemeanor and some felony convictions to be automatically sealed after applicable waiting periods. This change will affect many people with older conviction records in Virginia.

To file for expungement in Middlesex County, petition the Circuit Court in Saluda. Include arrest details and the legal grounds for your request.
