Loudoun County Court Records

Loudoun County has both a Circuit Court and a General District Court, both located in Leesburg. Each handles different types of criminal matters and maintains separate public records.

The Circuit Court handles felony criminal cases, including trials, sentencing, and appeals from the General District Court. Felony case records from Loudoun County are maintained at the Circuit Court. You can search them through the Virginia Judiciary online case search, or visit the clerk's office for certified copies. Certified copies carry a per-page fee set by state law.

The General District Court handles misdemeanor criminal cases, traffic violations, and preliminary hearings on felony charges. The Loudoun County Case Information page also provides direct links to the Virginia Judiciary's search tools. Under Virginia Code § 19.2-389, all criminal history record data is maintained statewide through the Central Criminal Records Exchange. This means you can search records from both court levels in Loudoun County through the same online system.

FOIA and Public Access in Loudoun County

Virginia's Freedom of Information Act at § 2.2-3704 gives you the right to request government records including arrest records. Records are presumed open unless a specific exemption applies. The Loudoun County Sheriff's Office and court clerks must respond to FOIA requests within five working days.

To submit a FOIA request, write to the records custodian at the agency holding the record. You don't need to give a reason. Describe the records clearly enough for the agency to find them. Include the person's name, approximate dates, and the type of record. Fees are capped at actual cost. If the request is expected to exceed $200, the agency may ask for a deposit before proceeding.

Virginia law requires that the identity of arrested persons, the charges against them, and the status of those charges be made public. Active investigations are exempt from disclosure. Juvenile records are confidential. For FOIA assistance, contact the FOIA Advisory Council at (804) 698-1810 or foiacouncil@dls.virginia.gov.

Note: Virginia's 2021 FOIA amendment opened access to closed criminal investigative files. Agencies may take up to 60 additional work days to respond to those types of requests.

Expungement of Loudoun County Arrest Records

Under Virginia Code § 19.2-392.2, you may petition for expungement if you were acquitted of charges, if the charge was dismissed or nolle prosequi, or if you were arrested but never formally charged and the record is misleading. An absolute pardon may also qualify you in certain situations.

Virginia expungement generally does not apply to convictions. If you were found guilty, that record stays. Starting in July 2025, new state laws allow certain misdemeanor and some felony convictions to be automatically sealed after applicable waiting periods pass. This change affects a large number of Virginians with old conviction records.

To file for expungement in Loudoun County, petition the Circuit Court in Leesburg. Include details about the arrest and the legal grounds for your request. You will need to submit fingerprints through the Virginia State Police for identity verification. The Commonwealth's Attorney will receive notice and may oppose the petition. A hearing will follow if there is a dispute. Filing fees apply at the Circuit Court clerk's office. Read the full statute using the Virginia General Assembly Code search.
